THE DRAMA CONTINUES

The Dobson’s have opened the store and are selling our merchandise for 50% off everything requesting cash only payment. I am presently in Labrador and unable to get back to Antigonish until Monday. Unfortunately the RCMP cannot enforce any action because they say this is a civil matter. I am unable to get action from my lawyer until Monday. All other agencies are closed as well until Monday. Meanwhile our store is being ransacked. Lisa Dobson has been seen trying on clothes for herself. The Dobson’s justify this because I withheld two weeks of rent while I waited for them to fix the persistent leak in our ceiling that was causing water damage to our merchandise. I have heard that they are telling the public now that I owe them $10,000. This is blatantly untrue (and slanderous). The amount is $1,825. to be exact.
Please do not support this action. Friends are already out there in front of the store taking photos and keeping an account of the goings on. If you would like to show your support it would be welcome.
Hopefully we should be back to normal on Tuesday when the lease reverts back to the Legion who are the owners of the building.

That can’t be legal but regardless, it’s hard to get back money that’s already been stolen. And who, I wonder, is doing the accounting for their 50% sales?
Exactly. But the law is not on my side right now. Hopefully in the future they will.
I really think that the RCMP is required to intervene to stop this action by the Dobson’s. If they have a claim against you their route is through the courts. It has been suggested to me that you call the RCMP and ask for a Risk Manager to contact you and see what steps can be taken to stop this action and have the dispute resolved though legal channels

I took your advice and received a call back from the Risk Manager at the RCMP. He told me that he is the only Risk Manager in the province and he presently has other life threatening matters to deal with. He said there’s nothing they can do – I just need to contact a lawyer on Monday. Meanwhile the Dobson’s will open the store again on Sunday and Monday to continue their ransacking. I will take this to the media for sure because we need to have better laws to protect us against this kind of thing. It’s like watching someone burglarize your home and being helpless to prevent it.
Call the media and have a staff member or trusted friend report what has happened. I would think the Dobsons won’t like this or maybe they won’t care. Sounds like they don’t have much intergrity anyways. At least your public and costomers would no the whole truth. Good luck this is awful!
Absolutely people should know that the sales are not authorized by you. Most (sorry I can’t say all) will refuse to shop until you are back running the store

I’m sure you know this but they are legally not allowed to say you owe them anything at all to them (from my understanding). Yes you can’t hold back rent but thats something that could have been sorted out in a completely different way. These people are thieves and I hope you take legal action! I will be trying to get in there to support you in any way. Good luck to you.

Those Fuckers.I heard about all of this from Flora at a concert in Bear River last night having been away all day at the Market , the Flight ,a massage ]and then the music.I am seeing the” Drama Continues” this morning now.You are absolutely justified in your reasons for withholding rent until the leaks are dealt with . You have been telling me about them for months ,and I dont know how else you can encourage action from the landlords, as you have tried everything else . They have already walked through your place of business without asking your permission .Be calm and determined and know that hundreds of friends love and support you, get a good Lawyer and give him plenty to work with. Your shareholders have to rally around you and their business, I am sure they will.

Its actually illegal to withhold rent no matter the situation. They are legally required to keep paying while they contact the rentalsmen to force the landlord to make repairs. I went through this last year, if she doesn’t pay rent for whatever reason they are completely within their rights to lock out a tenant. So honestly this lady is creating all her drama herself.
Wow. I am shocked/surprised! But you know, it’s easy to be nice to friends, and not too hard to be kind to strangers. It’s how a person treats another when there is money on the table and power on your side that really measures you. So sad for how you are being treated. A person who has moved here and given so much to better the community doesn’t deserve this.
Make sure you put the withheld rent in escrow to legally cover yourself later down the road. Shameful, I hope it works out for you.
Even with your justifiably withholding rent to get your landlord’s attention, there is usually a grace period regarding rental payment anyway. Two weeks does not justify their behavior which sounds blatantly illegal to me. Nothing could entitle these people to go into your place of business and take your belongings that you bought and paid for and start selling them. That’s stealing.
Were you able to get photos of what was happening? Witnesses?

NS Tenancies Board Act should protect you in this instance,I’m pretty sure they could instruct a Sheriff to padlock your property until this is dealt with…this is so wrong on so many levels!
